Welcome to CashCloud, a service provided by Printech Global Secure Payment Solutions, LLC. DBA CashCloud (“we,” “our,” or “us”). By accessing or using our services, you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, please refrain from using our services.

2. Definitions

  • Service: The CashCloud application, which assists businesses in managing their accounts payable payments.
  • User: Any individual or entity utilizing the Service.
  • Account: A User’s registered account to access the Service.

3. Account Registration and Responsibilities

  • Users must register an account to utilize the Service.
  • Users are responsible for maintaining the confidentiality of their account login information and for all activities that occur under their account.
  • Users agree to notify us immediately of any unauthorized use of their account or any other breach of security.

4. Subscription and Payment

  • We offer annual or monthly paid plans, billed at the commencement of the subscription period.
  • Payments are processed through Stripe. In the event of payment failures, Stripe will attempt to reprocess the payment. Users are responsible for ensuring that their payment information is current and valid.
  • Persistent payment failures may result in the suspension or termination of the User’s access to the Service.

5. Use of the Service

  • Users must comply with all applicable laws and regulations.
  • Prohibited activities include, but are not limited to:

    • Engaging in any fraudulent or illegal financial transactions.
    • Utilizing the Service to send money using an account for which the User is not authorized.
    • Accessing or attempting to access other Users’ accounts without authorization.
    • Distributing viruses or other harmful technologies that may damage the Service or its Users.
    • Engaging in any activities that may compromise the integrity or security of the Service.

6. Data Privacy and Security

  • We handle sensitive financial information, including bank account and routing numbers, with the utmost care and in compliance with applicable laws.

  • In the event of a data breach, we will promptly notify affected Users and take necessary steps to mitigate the breach.

7. SMS Communications

  • By utilizing our Service, Users consent to receiving SMS messages for notifications and verification purposes.
  • SMS messages are sent via Twilio. Standard message and data rates may apply.

8. Intellectual Property

  • All content and materials available on the Service are the intellectual property of CashCloud and its licensors.
  • Users are granted a limited, non-exclusive, non-transferable license to use the Service for personal or business purposes as intended.

9. Termination

  • We may terminate or suspend a User’s access to the Service under the following conditions:

    • Non-payment of subscription fees.
    • Suspected fraudulent or illegal activities.
    • Violation of these Terms.
    • Any other activities that may harm the Service or its Users.

10. Dispute Resolution

  • Any disputes arising from or related to these Terms or the Service will be resolved through binding arbitration, in accordance with the rules of the American Arbitration Association.
  • The arbitration will take place in Miami, Florida, and the arbitration award may be enforced in any court of competent jurisdiction.

11. Modifications to the Terms

  • We reserve the right to modify these Terms at any time.
  • Users will be informed of any changes via email to the email address associated with their profile. Continued use of the Service after such modifications signifies acceptance of the revised Terms.

12. Limitation of Liability

  • To the fullest extent permitted by law, CashCloud shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

    • Your use or inability to use the Service.
    • Any unauthorized access to or use of our servers and/or any personal information stored therein.
    • Any interruption or cessation of transmission to or from the Service.

14. Miscellaneous

  • These Terms constitute the entire agreement between you and CashCloud regarding the use of the Service.
